Dock Guidelines
All
structures placed in the water of Lake Lemon or watercourse within the
boundaries of the Lake Lemon Conservancy District (LLCD) must first be approved
by LLCD. LLCD management may grant
approval for an extended period of time, if no material alterations of the
original approval occur during the length of the permit. (Pursuant to 2-96-21 of the LLCD Code).
- The placement of a
dock, pier, boat lift, swimming raft, diving platform, mooring buoy, or
similar structure, as a general rule must meet the following conditions:
- Does not infringe on
the access of an adjacent landowner to the lake;
- Is a temporary
structure which is removable;
- Does not unduly
restrict navigation;
- Is not unusually wide
or long relative to similar structures within the vicinity of the lake;
- Does not extend more
than 60 feet from the adjacent shoreline. Distances greater than 60 feet from the adjacent shoreline
must receive LLCD management approval;
- All framing, flooring,
and walkway lumber or other materials shall be sized and spaced according
to load ratings published for the materials used;
- No lumber or timber
containing creosote is acceptable;
- During dock
construction, the permittee shall take steps as necessary to stabilize
the shoreline, using a method approved by LLCD management for a distance
of not less than twelve (12) feet to both the left and right of the
widest point of the dock design;
- Floatation equipment,
when used, shall be expanded synthetic material designed for use on
floating docks. Drums and/or barrels
are not acceptable.
- As used in this
section, a “temporary structure” means a facility which can be installed
and removed from the lake or watercourse of the Conservancy District
without the use of a crane, bulldozer, backhoe, or similar heavy or large
machinery.
- Examples of a
“temporary structure” include the following:
1.
A
dock which:
a.
Is
supported by auger poles or other poles resting on the lake bed or are screwed
into the lake bed;
b.
Is
not mounted in or comprised of concrete or cement; and
c.
Is
supported by portable floatation devices.
- No dock, pier or boat
ramp shall be placed upon or operated upon the waters of the lake for fee
or profit, for hire or rental to any other party either for a direct
payment in cash or payment in kind from such other party or as an incident
to other services provided to such party, except as specifically
authorized by license, lease or concession with the city or the LLCD. The rental of a dock, pier or boat
ramp, incidental to and included in the rental of a residence located
within the LLCD, is specifically exempted from the provisions of this
paragraph, so long as the renter of the residence is the only party using
the dock, pier or boat ramp.
